2. Scope and products

These terms govern purchases on maisonchatnoir.fr by consumers for their personal needs. Merchandise services, artwork and professional orders placed by quotation are governed by the terms expressly agreed for those orders; these terms of sale do not replace them.

Essential characteristics, materials, sizes, colors and customization techniques are presented on product pages. Consult the available size guide before ordering. Photographs may show slight variations due to screens and printing techniques, but this does not permit delivery of a product with different agreed characteristics or removal of statutory guarantees.

Some items are made or printed to order by our partners. Maison ChatNoir remains your seller and point of contact for order fulfillment, delivery, returns and guarantees.

3. Prices and payment

Consumer prices are shown in euros, inclusive of all taxes, excluding delivery charges, which are shown separately before confirmation. The total payable, applicable taxes, delivery charges and any discounts are summarized before payment. The applicable price is the price displayed and accepted when the order is placed.

Available payment methods are those offered at checkout. Placing an order entails an obligation to pay. Unless specific terms are expressly displayed and accepted, the full price is payable when ordering. Payments are processed by the payment providers offered in the store. Any payment installment arrangement is governed by the relevant provider's terms.

4. Orders and availability

The customer selects items and options, checks the cart and total, enters the necessary details, reads these terms and confirms the order with an obligation to pay. Information can be corrected before final confirmation. A confirmation is sent to the email address provided.

Offers are subject to product availability or the ability to manufacture them. If an item becomes unavailable after ordering, we notify you and offer a solution you accept or refund the amounts relating to unavailable products, without imposing a substitute.

Contact us promptly to request a change or cancellation. Changes to production depend on its progress. This does not remove the applicable right of withdrawal for non-personalized items or other statutory rights.

5. Production, delivery and tracking

Available destinations, delivery methods and charges are offered before order confirmation. For made-to-order items, the total timeframe includes production, preparation and transport: transit time alone is not the total delivery time.

The delivery date or timeframe agreed before ordering applies. If no timeframe is indicated or agreed, delivery takes place without undue delay and no later than 30 days after conclusion of the contract, in accordance with Article L. 216-1 of the French Consumer Code. A different timeframe may be expressly agreed before purchase for pre-orders or specific production.

An order may arrive in several parcels if products are prepared by different partners. The charges accepted when ordering remain the amounts due. Tracking is provided when available.

The customer must provide an accurate address and notify us promptly of errors. No reshipping charge payable by the customer will be incurred without prior information and agreement. For delays, losses or damaged parcels, contact Maison ChatNoir; we handle the necessary steps with our partners. Risk passes to the consumer when they take physical possession of the goods, subject to statutory exceptions.

In the event of a delay, the consumer may formally require the seller to deliver within a reasonable additional period and then terminate the contract if delivery does not take place, under statutory conditions. Immediate termination is possible, in particular, if delivery is refused or an agreed essential date is missed. Amounts due under the terminated contract are then refunded within 14 days.

6. Withdrawal and returns

For eligible purchases, you have a statutory right of withdrawal for 14 days after receipt. Maison ChatNoir also offers an extended 30-day return period for non-personalized items, subject to our return and refund policy, which explains return deadlines, refunds and charges and includes a model withdrawal statement.

For new orders placed from publication of this version, direct return costs for a change of mind or an unsuitable size chosen by the customer are payable by the customer. Necessary costs relating to an established lack of conformity or shipping error are covered by Maison ChatNoir. No restocking fee applies.

Return address: Maison ChatNoir, 6 rue des Fauvettes, 66670 Bages, France. Contact: contact@maisonchatnoir.fr. Do not return items directly to the manufacturer. Contacting us helps processing but is not a condition for exercising the statutory right.

Clearly personalized goods or goods made to the customer's specifications may be excluded from the right of withdrawal under Article L. 221-28 of the French Consumer Code. Making a standard item to order or selecting a standard size or color is not sufficient for this exclusion. Discounted items retain their statutory rights.

7. Statutory guarantees

Maison ChatNoir, at the contact details in section 1, is responsible for statutory guarantees. Consumers have 2 years from delivery of a new item to invoke the statutory guarantee of conformity. For a defect appearing within that period, they do not have to prove that it existed at delivery.

Consumers may request repair or replacement free of charge, within a maximum of 30 days and without significant inconvenience, subject to statutory conditions on choice and proportionality. Any period during which the item is unavailable suspends the remaining guarantee. An item repaired under this guarantee benefits from a 6-month extension. If the consumer chooses repair, the seller does not carry it out and replaces the item instead, a new 2-year guarantee begins on delivery of the replacement.

In the circumstances provided by law, particularly refusal to restore conformity, exceeding 30 days, significant inconvenience, costs permanently borne by the consumer or persistence of the defect, the consumer may obtain a price reduction and keep the item or terminate the sale and return it. A sufficiently serious defect permits an immediate request for a price reduction or termination. Termination cannot be imposed for a minor defect, whose minor nature must be demonstrated by the seller.

These rights arise from Articles L. 217-1 to L. 217-32 of the French Consumer Code, independently of any commercial warranty. Consumers also benefit from the guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. They may invoke it within 2 years of discovering the defect and request a price reduction while keeping the item or a refund in exchange for returning it.

Contact us with your order number and information describing the issue. Photos may help processing. Our suppliers' claim deadlines do not limit your statutory guarantees.

8. Complaints and dispute resolution

Send complaints to contact@maisonchatnoir.fr or by post to the registered office. You have the right to use a consumer mediator free of charge after a prior complaint remains unresolved. Maison ChatNoir has not currently appointed an organization; its contact details must be published after membership. This absence does not restrict your rights or access to the competent courts.

French law applies without depriving consumers of the mandatory protective provisions they benefit from. Statutory rules on jurisdiction apply to disputes; no exclusive jurisdiction is imposed on consumers.

9. Personal data and artwork

Data processing is described in our privacy policy. Artwork, graphics and content remain protected by their owners' rights. Buying an item does not transfer any right to reproduce or exploit the artwork.
